GENERAL TERMS AND CONDITIONS

These general terms and conditions are governed by4N Gasztronómia Korlátolt Felelősségű Társaság(registered office: 1155 Budapest, Rákos út 102., 10th floor 64., represented by: Csahók Ibolya, tax number: 25726282-2-42, registering authority: Budapest Metropolitan Court of Registration, bank account number:

12100011-17954011, hereinafter referred to as Stand Restaurant) and the rights and obligations of customers using the services provided by it on this website (www.standrestaurant.hu).

Before finalizing their order onwww.standrestaurant.hu, customersare required to familiarize themselves withthe provisions of these GTC. These GTC form part of the contract between the customer and Stand Restaurant.

Stand Restaurant therefore asks customers to save and/or print these GTC before submitting their order. The contract concluded is considered a written contract. The language of the contract is Hungarian.

I. Use of the site

1. Anyone is entitled to use the services of this website. No separate registration as a user on this website is required to use the services available on this website.

2. If a customer decides to make a purchase on this website, they must provide their first and last name (or company name) and the billing address to which the invoice will be sent. Stand Restaurant advises customers that it is important to provide their telephone number and email address during the purchase process to ensure that the order is fulfilled correctly. Customers may also add other comments during the purchase process.

3. Stand Restaurant hereby requests that customers ensure that all information provided in any orders is accurate and error-free. Stand Restaurant accepts no responsibility for any delays, errors, or difficulties arising from inaccurate information and expressly excludes any liability in this regard.

By placing an order, the customer acknowledges that Stand Restaurant is entitled to pass on to the customer any damages and costs resulting from incorrect data entry or inaccurate information provided by the customer. Stand Restaurant excludes its liability for performance based on inaccurate data entry. The customer is advised that an incorrectly entered email address or a full mailbox may result in the non-delivery of the confirmation and may prevent the conclusion of the contract.

 

4. Stand Restaurant hereby requests that customers do not make purchased and downloaded gift vouchers available to unauthorized persons. Stand Restaurant accepts no responsibility for any cases or any resulting damages if the purchased gift voucher becomes accessible to unauthorized persons as a result of conduct attributable to Stand Restaurant.

5. Stand Restaurant informs the customer that the data provided by the customer and specified in point 2 above will be processed in accordance with the relevant legislation, solely for the purpose of fulfilling the contract, and will be stored for the period specified in the legislation.

6. By accepting these general terms and conditions, the customer voluntarily gives their informed consent for Stand Restaurant to process and store this data.

 

II. Ordering and purchasing via this website

1. Stand Restaurant informs the customer that online purchases made through this web store are considered contracts concluded between absent parties as defined by Government Decree 45/2014. (II.26.) on the detailed rules of contracts between consumers and businesses (hereinafter: "Government Decree").

2. Stand Restaurant informs the customer that the price shown includes VAT and other mandatory charges, which are essential features of the contract.

3. The customer may order and purchase products. The customer must select the product or products they wish to purchase by clicking on the "Add to cart" button and then specifying the quantity of the product they wish to purchase. The selected quantity can be modified.

4. The system then displays the contents of the virtual shopping cart, which contains all the products that the customer is about to order.

5. The customer then finalizes their order by providing the information specified in point 2 and can pay for the product by credit card. After payment, the customer can download the purchased gift voucher. Stand Restaurant hereby informs the customer that it will not send the voucher to the customer by separate mail.

The gift voucher can only be paid for by credit card; advance payment or other payment methods are not possible.

 

6. Gift vouchers purchased on this website may only be used for food and/or drink at Stand Restaurant, located at 1061 Budapest, Székely Mihály utca 2, for a period of eight months following purchase. They cannot be exchanged for cash, either in whole or in part. Only the person who first presents the gift voucher to Stand Restaurant after purchase is entitled to use it. The gift voucher cannot be used partially (in terms of time or value) and can only be used once. If, during use, the customer does not purchase goods or services up to the value specified on the gift voucher, the customer is not entitled to a refund or subsequent use of the difference. The recipient of the gift voucher can only be a natural person.

 

III. Specific features of contracts concluded between absent parties, withdrawal/termination

1. The customer may withdraw from a contract concluded between absent parties within fourteen calendar days without giving any reason. If the gift voucher is used, the contract shall be deemed to have been performed in accordance with the contract and cannot be withdrawn from. In the event of withdrawal, Stand Restaurant shall cancel the gift voucher as a usable voucher.

2. The customer may exercise their right of withdrawal verbally or in writing. In the case of written withdrawal, it shall be considered valid if the customer sends their statement before the deadline. Stand Restaurant requests that customers send any statements of withdrawal in a manner that can be verified at a later date, in particular by registered mail and/or with return receipt requested.

3. In the event of exercising the right of withdrawal, Stand Restaurant is obliged to refund the amount paid by the customer immediately, but no later than fourteen days after the withdrawal.

 

IV. Complaint handling

Consumers may submit complaints regarding the product or the activities of Stand Restaurant using the following contact details:

Entry in the customer book. The customer book is available at Stand Restaurant (customer service). Stand Restaurant will respond in writing to entries made here within thirty days.

The consumer may submit their complaint verbally or in writing.

Stand Restaurant is obliged to immediately investigate verbal complaints and remedy them as necessary. If the consumer does not agree with the handling of the complaint or if it is not possible to investigate the complaint immediately, Stand Restaurant is obliged to immediately record the complaint and its position on it and, in the case of a verbal complaint, to hand over a copy of the record to the consumer on the spot.

In the case of verbal complaints made by telephone or other electronic means of communication, the consumer must be sent a substantive response within 30 days at the latest, in accordance with the requirements for responding to written complaints. In all other respects, the following procedure must be followed for written complaints. 

Unless otherwise provided for in a directly applicable legal act of the European Union, Stand Restaurant is obliged to respond to written complaints in writing within thirty days of receipt and to take action to communicate its response. A shorter deadline may be set by law, and a longer deadline may be set by statute. Stand Restaurant is required to justify its decision to reject a complaint. Stand Restaurant is required to assign a unique identification number to verbal complaints made by telephone or electronic means of communication. The record of the complaint must include the following:

  • the consumer's name and address,
  • the place, time, and manner of filing the complaint,
  • a detailed description of the consumer's complaint, a list of documents, papers, and other evidence presented by the consumer,
  • Stand Restaurant's statement on its position regarding the consumer's complaint, if the complaint can be investigated immediately,
  • the signature of the person recording the minutes and, except in the case of verbal complaints made by telephone or other electronic means of communication, the signature of the consumer,
  • the place and time of recording the minutes,
  • in the case of a verbal complaint made by telephone or other electronic means of communication, the unique identification number of the complaint.

 

Stand Restaurant is required to keep a copy of the complaint report and a copy of the response for five years and to present them to the supervisory authorities upon request.

If the complaint is rejected, Stand Restaurant is obliged to inform the consumer in writing about which authority or conciliation body can initiate proceedings depending on the nature of the complaint. The information must also include the name, telephone number, website, and mailing address of the competent authority or the conciliation body in the consumer's place of residence or stay. The information must also indicate whether Stand Restaurant will use the conciliation body's procedures to resolve the consumer dispute.

If any consumer dispute between Stand Restaurant and the consumer cannot be resolved through negotiations, the following legal remedies are available to the consumer:

If Stand Restaurant rejects the consumer's complaint, the consumer is entitled to refer the matter to the Conciliation Board competent for their place of residence or stay: the condition for initiating proceedings before the Conciliation Board is that the consumer must first attempt to settle the dispute directly with Stand Restaurant.

After assessing the complaint, the authority decides whether to initiate consumer protection proceedings. First-instance consumer protection tasks are performed by the metropolitan and county government offices competent for the consumer's place of residence. Stand Restaurant is subject to a cooperation obligation in the conciliation proceedings.

Within this framework, Stand Restaurant isobliged to send a response to the conciliation body's request, anditis alsoobliged to appearbefore the conciliation body ("ensuring the participation of a person authorized to reach an agreement at the hearing").

If the registered office or place of business of Stand Restaurant is not located in the county where the chamber operating the competent conciliation body is based, Stand Restaurant's obligation to cooperate extends to offering the possibility of concluding a written agreement in accordance with the consumer's request.

In the event of a breach of the above cooperation obligation, the consumer protection authority has the power to imposemandatory fineson businesses for unlawful conduct as a result of the change in legislation, with no possibility of waiving the fine.

The conciliation body's proceedings are initiated at the consumer's request. The request must be submitted in writing to the chair of the conciliation body: The written requirement may be met by letter, telegram, telex, fax, or any other means that allows the addressee to store the data addressed to him or her for a period of time appropriate to the purpose of the data and to display the stored data in an unaltered form and content.

 

The application must include

  • the consumer's name, place of residence or place of stay,
  • the name, registered office, or relevant place of business of the business involved in the consumer dispute,
  • if the consumer requested the designation of the competent conciliation body instead of the competent conciliation body,
  • a brief description of the consumer's position, the facts supporting it, and the evidence for those facts,
  • a statement by the consumer that he or she has attempted to resolve the dispute directly with the business concerned
  • the consumer's statement that no other conciliation body has been involved in the case, no mediation procedure has been initiated, no statement of claim has been filed, and no application for a payment order has been submitted,
  • a motion for a decision by the body,
  • the consumer's signature.

 

The application must be accompanied by the document or a copy (extract) thereof, the content of which the consumer refers to as evidence, in particular the written statement of Stand Restaurant rejecting the complaint, or, in the absence thereof, other written evidence available to the consumer of the attempted conciliation.

If the consumer acts through an authorized representative, the power of attorney must be attached to the application.

The consumer is entitled to enforce their claim arising from a consumer dispute in court in civil proceedings in accordance with the provisions of Act V of 2013 and Act CXXX of 2016.

The European Commission has set up a website where consumers can register, enabling them to settle disputes relating to online purchases by filling out a form, thereby avoiding court proceedings.

On the portal, the consumer and Stand Restaurant, against whom the complaint was lodged, can jointly select the dispute resolution body to which they wish to refer the complaint.

V. Other provisions

1. A price of 0 forints or a price from which it can be clearly concluded, based on the circumstances of the case, that the price has been incorrectly indicated, shall be considered an obviously incorrect price.

In the event of an incorrect price being displayed, Stand Restaurant offers the option of purchasing the product at its actual price, based on which information the customer can decide whether to order the product at its actual price or cancel the order without any adverse legal consequences.

2. Stand Restaurant informs consumers that their warranty and other rights are set out in, among other things, Act V of 2013 and Government Decree 45/2014. (II.26.) on the detailed rules of contracts between consumers and businesses.

3. Stand Restaurant reserves the right to amend the provisions of these general terms and conditions at any time, and such amendments shall take effect upon publication on the website https://standrestaurant.hu/hu. Stand Restaurant hereby requests its customers to read the current general terms and conditions before placing each order.
